Terms and Conditions of Sale
1. Purpose
These Terms and Conditions of Sale govern the subscription to and use of the online membership providing access to the Le Club – Golf Elevation educational platform, offered under the Golf Elevation trade name by MC Dynamics, through www.golf-elevation.com and/or the Thinkific platform.
By subscribing to a membership, the User fully and unconditionally accepts these Terms and Conditions of Sale.
The membership provides access, for the duration of the active subscription, to the content and services made available through the Le Club platform, according to the subscription plan selected.
2. Target Audience
Le Club is an educational platform primarily intended for young golfers and their parents who wish to gain a better understanding of the different aspects involved in the development and progression of a young golfer, including golf performance, organization, training, high-performance pathways, U.S. college golf opportunities, and related topics.
When the User is a minor, the subscription must be purchased by their legal representative or with their authorization.
The content provided is intended solely for educational and informational purposes. It does not constitute an official certification, nor does it guarantee any specific progress, sporting results, college recruitment, scholarship, or any other particular outcome.
3. Prices and Payment
3.1 VAT
MC Dynamics is subject to VAT.
The applicable VAT is determined in accordance with current regulations, particularly depending on the nature of the User, their place of residence or establishment, and the tax rules applicable to digital services.
3.2 Prices
The subscription price is the price displayed on the subscription page at the time of purchase.
Prices are displayed in euros (€) and include all applicable taxes in accordance with current regulations.
3.3 Invoicing
An invoice is issued in accordance with the procedures provided by the payment platform once payment has been successfully processed.
3.4 Payment Currency
All subscriptions are payable in euros (€).
3.5 Changes to Prices
MC Dynamics reserves the right to modify its subscription prices.
Any price change affecting an existing subscription will be communicated to the User before it takes effect, in accordance with applicable legal requirements.
The new price may only be applied from a subsequent subscription period and after the User has been informed in advance.
The User may cancel their subscription before the new price takes effect if they do not wish to accept the change.
3.6 Payment Methods
Subscription to Le Club is completed online through the Thinkific platform.
Payment is made by credit or debit card or by any other payment method offered at the time of subscription. Payments are processed by the payment service providers integrated into the platform, including Stripe.
MC Dynamics does not directly store the User’s complete banking or payment card information.
4. Subscription Term, Renewal and Cancellation
The subscription is entered into for the duration and billing frequency indicated at the time of purchase.
Unless otherwise stated at the time of subscription, the subscription is automatically renewed at the end of each billing period, and the payment method on file will be charged the amount corresponding to the new subscription period.
The User may cancel their subscription at any time through their personal account, where this functionality is available, or by contacting Golf Elevation at: contact@golf-elevation.com.
Cancellation will take effect at the end of the subscription period already paid for. Unless otherwise required by law, cancellation does not entitle the User to a refund for a subscription period that has already begun.
The User will retain access to the platform until the end of the period for which the subscription has been paid.
At the end of this period, access to content reserved for subscribers will automatically terminate.
5. Access to the Platform
Once payment has been successfully processed, access to the platform is generally immediate.
Access is strictly personal. Login credentials may not be shared, transferred, or made available to any third party.
The User is responsible for maintaining the confidentiality of their login credentials and for all use of their account.
In the event of unauthorized sharing of login credentials or unauthorized reproduction or distribution of content, MC Dynamics reserves the right to suspend or terminate access to the account, without prejudice to any other remedies available to it.
Access to the platform requires an Internet connection and compatible equipment, which remain the responsibility of the User.
6. Changes to the Platform and Content
Le Club is an evolving educational platform.
New content, videos, resources, documents, modules, masterclasses, or other materials may be added on a regular basis.
MC Dynamics also reserves the right to update, modify, reorganize, or remove certain content in order to maintain the relevance, quality, and educational development of the platform.
Such changes shall not entitle the User to a refund, provided that they do not substantially alter the service covered by the subscription purchased.
MC Dynamics may also carry out maintenance operations that may result in temporary interruptions to access to the platform.
7. Right of Withdrawal
In accordance with the provisions of the French Consumer Code, where the User qualifies as a consumer, they are in principle entitled to a 14-day withdrawal period from the date on which the contract is concluded.
Where the User requests immediate access to the platform before the end of this period, the consequences of exercising the right of withdrawal shall be determined in accordance with the legal provisions applicable to digital services and digital content.
Where the legal conditions for the loss of the right of withdrawal are met, particularly where the performance of digital content has begun with the consumer’s prior express consent and their express acknowledgment that they thereby waive their right of withdrawal, the consumer will no longer be entitled to exercise this right in relation to the relevant content.

8. Intellectual Property
All content available through Le Club, including but not limited to videos, texts, documents, templates, exercises, educational materials, resources, visuals, methods, and graphic elements, is protected by applicable intellectual property laws.
Unless otherwise stated, such content is the exclusive property of MC Dynamics / Golf Elevation or is used with the authorization of its respective rights holders.
The subscription grants the User only a personal, private, and non-transferable right to access and use the content for the duration of their subscription.
Any unauthorized reproduction, copying, downloading, distribution, transmission, resale, making available, publication, or sharing, whether in whole or in part, of the platform’s content is strictly prohibited without the prior written authorization of MC Dynamics.
9. Liability
MC Dynamics makes every reasonable effort to provide reliable, relevant, and high-quality educational content.
However, the information and recommendations provided through Le Club are intended for educational and informational purposes. They must be adapted to each player’s individual circumstances, level, age, and objectives.
MC Dynamics does not guarantee any specific sporting result, ranking, progression, selection, college admission, recruitment, athletic or academic scholarship, or any other particular outcome resulting from the use of the platform.
The User remains responsible for how they use and apply the information and resources provided.
MC Dynamics shall also not be held liable for interruptions or malfunctions resulting in particular from Internet connection issues, the User’s equipment, third-party services, or maintenance operations beyond its control.
10. Personal Data
Personal data collected when creating an account, subscribing to and using the platform is used, in particular, to provide access to the service, manage subscriptions and payments, and manage the relationship with Users.
Personal data is processed in accordance with applicable regulations, including the General Data Protection Regulation (GDPR).
The User has the rights provided for under applicable data protection laws in relation to their personal data.

11. Suspension or Termination of an Account
MC Dynamics reserves the right to suspend or terminate a User’s account in the event of a serious or repeated breach of these Terms and Conditions of Sale, including the sharing of login credentials, unauthorized reproduction or distribution of content, attempted fraud, or failure to make payment.
Where reasonably possible, the User will be informed prior to the suspension or termination of their account and will be given an opportunity to remedy the situation.

13. Amendments to These Terms and Conditions
MC Dynamics may amend these Terms and Conditions of Sale, particularly to reflect changes to the platform, its services, or applicable laws and regulations.
Where such changes have a significant impact on an existing subscription, the Users concerned will be informed before the changes take effect.
The applicable version shall be the version in force on the date of subscription or, where legally applicable, the version subsequently accepted by the User.
14. Governing Law and Dispute Resolution
These Terms and Conditions of Sale are governed by French law.
In the event of a difficulty, complaint, or dispute, the User is invited to first contact MC Dynamics at contact@golf-elevation.com in order to seek an amicable resolution.
Where the User qualifies as a consumer, they are also entitled to benefit from consumer mediation procedures and the rules governing jurisdiction provided for under applicable law.
If an amicable resolution cannot be reached, the dispute shall be submitted to the competent courts in accordance with applicable legal provisions.
